摘要
建设项目入河排污口设置往往会对附近水域内现有取水户、已获得取水许可预申请的申请人、渔业养殖户等第三者产生不利的影响,致使第三者对水资源的利用权益受到侵害。为了保护好第三者对水资源的利用权益,采取有效的防控措施自然就成了避免或降低建设项目入河排污口设置对第三者影响的关键所在。结合实际案例,列举了一些常见的对第三者影响的防控措施,并对其适用性作出了较为客观地分析,从而为建设项目合理地设置入河排污口提供了有益的参考。
The setting of construction project sewage outfall often produces a great deal of harmful effects to the third parties in vicinity such as existing water users, applicants who have received pre-application for water withdraw permit, fisheries farmers, etc. Thus the third parties interests in the use of water resources will have been infringed. In order to protect the third parties interests in the use of water resources, taking effective prevention and control measures will natUrally become a key point to avoid or reduce the influence of the setting of construction project sewage ouffall upon the third parties. With an actual case, some common measures against the influence are listed in this paper. And a more objective analysis is made on the applicability of the measures, So a useful reference is provided for the rational setting of Construction project sewage outfall.
