摘要
“道德法”是泛道德主义观念影响法律领域的一种表现。儒家的法律思想实际上是一种道德法思想 ,它主要包括以下内容 :在立法方面 ,主张把道德的法律化作为基本的价值追求 ;在司法方面 ,主张把“中庸”与“慎刑”作为司法公正的实现途径 ;在治国方面 。
The moral law is the expression of the extensive moral ideas influencing the legal field.In fact legal thought of the Confucian school is actually a moral law by nature.It includes the following aspects:In respect of judicature,the Confucian school proposed that the legalization of morality be transformed into fundamental pursue of values.In respect of judicature,the Confucian school declared that the golden mean and cautious punishment be channels of realizing judicial justice. In respect of running the state, the Confucian school proclaimed that the rule of virtue be considered as the basic adminitraive policy of a country.
