摘要
从"软法"视角对国际体育法的构成进行了分析。国际体育法由硬法与软法两大板块构成,其中硬法构成了国际体育法的内核,软法是其外围。由于体育特殊性使然,未来国际体育法的发展将要倚重软法之治,但是,并非轻视硬法的作用。"软硬兼施,刚柔并济"是国际体育治理发展的合理道路。
The international sports law was analyzed with the help of ＂soft law＂ and it is made up of two parts： soft law and hard law,of which the former is the outside,the latter is the core of the international sports law.Considering the particularity of sports,the development of the international sports law will rely more on soft law without neglecting the role of hard law.＂To use both hard and soft tactics and to couple hardness with softness＂ will be the rational way to develop and govern international sports.
