摘要
矿产资源品的开发利用需兼顾市场效率与社会公平两类目标的均衡,这是保障矿业安全而进行政府管制的价值基础,矿业安全的管制研究即是以此为基础,利用管制经济学的研究方法来划分矿业管制与市场机制的边界,为矿业安全和有序发展提供制度保障。中国矿业市场的治理应从"控制式的行政管制"向"协作式的市场规制"转型,充分发挥政府规制、自由市场与社会组织的力量,构建三者协作共管的"三维一体"均衡管制机制。矿业安全管制的有效边界应通过对矿业管制的成本—收益分析与风险控制分析的方法加以解决,以实现矿业管制过程中市场效率与社会公平。
The development and utilization of mineral resources need the balance between the market efficiency and social equity, which is the value base of government regulation to protect the safety of mining. The study of the regulation of mining safety is to divide the border between government regulation and market mechanism for the aim of keeping the mining safety and order. As for China, the governance of mining should be transformed from the controlled project regulation to the collaborative market regulation so as to fully display the function of government regulation, free market and social organizations and build a three-dimensional regulation mechanism. This paper concludes that the border of mining regulation should be solved by cost-profit analysis and risk control analysis in order to achieve the regulation efficiency and social equity.
