摘要
生态文明作为一种整体性文明形态,对法治建设具有全面的、长期的影响,主要表现在法治建设的生态化方面。生态文明作为在工业文明基础上发展起来的新的文明形态,对法治建设具有改革性、渐进性影响;它要求法治建设坚持"以人为本,以自然为根,以人与人和谐和人与自然和谐为魂"。生态文明作为以环境生态保护为主要内容的文明形态,对环境资源法治建设具有根本性影响;它要求生态文明法治建设以环境资源法治建设作为重点,在环境资源法治建设中重视综合生态系统方法理论。积极推进和加快生态文明建设,对法治建设具有日益增强的紧迫性。
As an integrated form of civilization,eco-civilization has a comprehensive and long-term impact on legal system construction,mainly in the aspect of ecological legal system construction.Eco-civilization,as a new form of civilization,is developed on the basis of industrial civilization.It has a reformed,progressive impact on legal system construction.It emphasizes human-oriented,nature-rooted,and taking harmony between human and human as well as between human and nature as its spirit.Eco-civilization,as a form of civilization which focuses on environmental protection,has a fundamental and crucial impact on legal system construction of environment resource.It demands that the legal system construction of environment resource should come into the first place in the process of eco-civilization legal system construction.And the comprehensive eco-system methodology should be highly valued in the process of environment resource legal system construction.The active promotion and acceleration of eco-civilization construction could bring a pressing impact on the rapid legal system construction.
