摘要
"囚徒困境"是博弈论在侦查讯问中的具体应用,其研究对象是共同犯罪形态下的犯罪嫌疑人在侦查讯问中的博弈行为。"囚徒困境"是完全信息静态条件下的非合作博弈,所有犯罪嫌疑人都选择招供的"纳什均衡"是该博弈的解,这也正是侦查讯问工作的目的所在。"囚徒困境"在侦查讯问中的运用需要满足理性人、静态博弈和利益驱动三个基本条件,故应当从调整讯问策略和构建相关法律制度两个方面加以解决。
The ＂Prisoner Predicament＂ is the specific application of game theory in the investigation,whose research object is the suspect＇s game playing in the enquiry.under the joint offence situation The ＂Prisoner Predicament＂ is the uncooperative game playing in the completely information quiescent condition,what all the suspects choose to commit is the answer to the game,that is the ＂Nash Balance＂,and is the very purpose of the question.In the investigation,the application of ＂Prisoner Predicament＂ should meet the three basic conditions of reasonable person,static state game and driving profit,as a result,we should solve the problem from the following two aspects：adjusting question strategy and building the relating legal institutions.
