摘要
一边是国内电视节目市场愈演愈烈的"克隆"风,一边是寻求对其电视节目版式进行保护的栏目组屡屡碰壁。造成这种现象的主要原因在于受到思想表达二分法的阻碍,电视节目版式迟迟无法得到《著作权法》保护。然而,被版权界视为"神话"的思想表达二分法,并非无懈可击,电视节目版式符合作品认定的实质和形式要件,理应得到《著作权法》的保护。
Nowadays TV program market has a high rate of homogenization,while the creator is refused when seeking for protect.The main reason for this phenomenon is that TV program format is some kind of＂idea＂,which could not be protected by our＂copyright law＂.The＂copyright law＂protects only the expressions of ideas rather than ideas themselves,which is called the principle of expressions and ideas.However,the principle of expressions and ideas,which is treated as a＂myth＂is not perfect.,the TV program format is acceptable for both essence and the form rules,it should be protected by the＂copyright law＂.
