摘要
长期以来对于量刑建议的纷繁争论,随着《关于规范量刑程序若干问题的意见(试行)》的出台都基本平息。随之而来的,是如何在司法实践中规范量刑建议,对此本文结合具体实践情况,着重从量刑证据收集、量刑幅度、量刑举证、辩论等方面进行分析探讨。
The dispute about the measurement of penalty has been nearly settled down since the advent of Suggestions on the Standards of the Measurement of Penalty Procedures, following which is how to regulate the suggestions on the measurement of penalty in juristic practice. This paper is aimed at exploring it from proof collecting, measurement range, measurement testimony and debate, etc.
