摘要
诊所法律教育的公益价值通常体现在为弱势群体提供法律帮助上。基于目标的一致性、形式的同一性和主体的兼容性,公益诉讼应当成为诊所法律教育追求公益目标的另一条重要途径。建立公益诉讼诊所不仅可以拓展诊所法律教育的公益价值,也可以增加诊所的案源、促进诊所教学模式的转变并为诊所的组织和管理带来便利。公益诉讼诊所应当立足于主动发现案源,并采取直接提起公益诉讼或者支持当事人提起诉讼的方式运行。
Generally,providing legal assistance for disadvantaged groups is the main public value of clinical legal education.Public interest litigation is consistent with the clinical legal education in the target,form and subject,so participating in public interest litigation should be an important part of clinical legal education.Through establishing public interest litigation clinic,we can expand the value of clinical legal education,increase the case,change the teaching methods,and improve the organization and management of clinic.We should sue directly or support the parties to sue in public interest litigation clinic.
