摘要
从历史渊源看,中国古代法律文化构成了当代中国的历史根基最深厚、民族认同感最强烈、实际影响最深远的法律文化传统。自19世纪以来,中国社会已开始发生一场不可逆转的、深刻的社会变革,中国传统法律文化所赖以生存的社会物质生活条件正在逐步地失去,而开始面临着一种全新的生存环境。古代法律文化作为一个整体已经瓦解,但其包含的很多因素则分散地以各种形式延续下来,法律意识、风俗习惯、行为方式等不少内容在现代仍具有建设性价值。
In the perspective of historical source,the law culture in ancient China makes up the law cultural tradition that has historical foundation,national identity and far-reaching.Since the nineteenth century,the social reform has been taking place in China and the material living conditions that China traditional law culture depends on are losing and face a new situation.The ancient law culture,as a whole,is gone,but some elements have survived such as law consciousness,customs,acting way and so on.
