摘要
自我国放开农村土地流转市场以来，各地逐步推出了各种流转农村土地的模式。但是，农村土地流转的成与否不仅决定于政策因素，更决定于自然条件、经济环境、社会环境等诸多因素。所以，在我国目前整体社会保障水平不高、经济不够发达的情况下，在采用转包及出租等方式流转农村土地时，应该赋予农民在失去生活保障时的协议解除权。同时，应对行使解除权的农民采取一定程度的限制措施，保障协议相对方的利益。
Since the rural land market is opened in our country, several modes have been devised to circulate the local rural land. However, the key elements which decide the success of the ciculation of rural land are not only the policy, but also the condition of nature, economy and society, etc. Therefore, as the system of our social security is not perfect yet, and the economy is not highly developed, when it is to substract or to lease the rural land, the cancellation right shall be vested in the umemployed peasents. Meanwhile, some restrictions shall be imposed on the exercise of such right so to protect the rights and the interest of the other party.
