摘要
程序的启动是人民调解协议司法确认的首要环节。有关启动的诸事项当采如下立场:无须双方共同申请,单方当事人即可申请确认;必须明确申请期限,以达成协议后七至十五日之间为宜;应当以调解组织所在地的基层法院为管辖法院;对受理范围无须作具体列举,经人民调解委员会调解达成的调解协议均可申请确认;申请确认无须交纳费用,但是应该有相关配套措施以防止当事人滥用程序权利。
The program starting is the first step in judicial confirmation process of people＇s mediation agreement. It should act upon the following principles. At least one party is needed to request for confirmation,we should decide on the application period which is from 7 to 15 days;the court which has jurisdiction is the grassroots court in the locality of that mediation organization , all of the mediation agreement can apply for confirmation without itemizing the range of acceptance;application costs nothing,but some complementary measures should be established to prevent the procedural rights abuse.
