摘要
宪法概念是指运用于宪法陈述之中并具有特定意义的术语,是在宪法文本中使用,对各种宪法现象的共同特征加以概括、抽象后所形成的权威性法律范畴。宪法概念的"显功能"主要体现为准确表达宪法的要求,减少宪法表述的模糊性和歧义性,从而促进宪法调整各项目标的实现。根据宪法概念所反映的事物的性质,可把宪法概念划分为事实概念、规范概念、价值概念等类型。根据宪法关系的构成要素,宪法概念分为主体概念、内容概念、客体概念和关系概念等。宪法概念的规范性是宪法保持稳定性的基础。
The constitutional concept,as the term of a specific meaning,being used in the text of the constitution and the constitutional statement,is the authoritative legal category,which summarizes the common phenomenon of the constitution for a variety of features.Conceptual structure of the constitution refers to the constitutional concept of species and their relationships.＂Significant features＂ of constitutional concept mainly reflects the constitutional requirements for the accurate expression,expressed in the constitution to reduce ambiguity,so as to promote adjustment of the objectives of the constitution.According to the constitution to reflect the concept of the nature of things,the concept of the constitution can be divided into the fact concept,the standard concept,and the value concept..According to the constitutional relationship of the elements,the constitution concept can be divided into the of the subject concept,content concept,object concept and relationship concept.The normative of constitution concept is the basis to maintain the stability of the constitution
