摘要
我国在中印边界谈判中加强法律应对,有利于实现我国的谈判策略。在中印边界谈判中,我国可以利用国际法驳斥印度提出的划界主张,论证"麦克马洪线"是非法的,以及中印争议地区的领土主权属于我国。此外,我国还有必要依据衡平原则对中印传统习惯线进行合理调整,以求中印两国在互谅互让的基础上"一揽子"解决中印边界问题。
Better legal reply to Indian delimitation claims can help the government to achieve the negotiation tactics.Our country should refute the Indian delimitation legal advocates,proving that the ＂McMahon Line＂ is illegal,and the disputed territory belongs to China in the Sino-Indian boundary negotiation.Moreover,China should adjust the Sino-Indian traditional custom line by equity based on the international law in order to resolute the Sino-Indian boundary dispute by a package scheme.
