摘要
对近代租佃制的认识关乎传统农业经济的顺利转换。以往租佃制被视为地主经济乃至封建制度的基本要素,而超越这一叙述框架并展开技术分析,却可发现其本土色彩浓厚的独特构造:从租佃制的形态看,租佃比例和地租率反映了土地占有权和收益权的分割,而一田多主则体现了占有、使用、收益、处置等权利的复杂化;从租佃制的功能看,租佃经营不仅是一种组合各类要素的生产方式,更是以土地为中介的资金运作方式,发挥着现代金融工具产生前的财富保值增值功用;从地权构造的内涵来看,无论是权利的类别与主体,还是权能大小、时间长短、交易和衍变过程,租佃制度具有相当大的弹性,是与中国实际相适应的反映生存智慧的产权形式。
In the process of China＇ s modernization the continuation and reformaiton of tradition is especially remarkable, and the recognition of a special arrangements centering the tenancy system will help to analyse the realistic problem of land circulation. Through global investigation of the current discussion, and we find it transfer more and more from land occupying and rent share to technical analysis including business income and factors flow. The historical introspection can make today＇s land system selection suddenly enlightened and lay the foundation for rational smooth transition.
