摘要
行政自由裁量作为行政权的核心领域,其存在有必然性与正当性,但也存在着被滥用的危险。加强对行政自由裁量权的控制,是行政法的重要任务。除了制定法(硬法)的控制外,软法的控制也必不可少。应当通过立法目的、立法精神指引行政自由裁量权;通过法律程序规范行政自由裁量权;通过行政惯例约束行政自由裁量权;通过裁量基准规制行政自由裁量权,以保证行政自由裁量权正当合法地行使。
Administrative discretion,as the core areas of executive power,there is necessity and legitimacy of its existence,but there is the risk of abuse.Strengthen the control of administrative discretion is an important task of administrative law.In addition to statutory law（hard law） of control,control of soft law is also essential.Should guide the administrative discretion through the legislative intent and the legislative spirit;Through the legal norms of administrative discretion;bound by the administrative practice of administrative discretion;discretionary basis through the regulation of administrative discretion,in order to ensure the legitimate exercise of administrative discretion.
