摘要
商事责任是私法责任,它与传统民事责任的不同之处在于融入了类似于经济法责任的"混合性因素",这些因素是为商法特有的营利属性服务的。商法配合着同样作为市场经济基本法的民法、经济法,在维护社会的基本秩序方面发挥着至关重要的作用。
Commercial responsibility is a judicial responsibility and a special service for profits in commercial law.The difference between the commercial and civil responsibility is the ＂mixed-facts＂ used in economic law responsibility.The commercial law plays an key role in maintain social fundamental rule with the market economic basic law-the civil law and economic law.
