摘要
睡虎地秦简和张家山汉简等出土资料中涉及性问题的内容,反映了秦社会对性问题的法律规范情况,但在强调王子犯法与庶民同罪的秦社会中却仍有大量性违法现象存在,且并未受到应有的处罚,这有悖于秦的法治原则。但我们改换一下视角,从民间习俗和道德风尚方面考虑,就会发现社会的价值取向影响了这一方面的司法实践。
The unearthed materials of ShuisHuDi QinJian and Zhang Jiashan HanJian involves some sexual contents that reflect the law and regulations of Qin society.However,while emphasizing the equality and justice of the state law,there are some sexual crimes remaining not punished by the law,which went against the legal principles of Qin dynasty.If we change our perspective and see it from the aspects of common practice and morality,we could find that the social value has changed the legal practice,resulting in the loose execution or light punishment for sexual crimes.
