摘要
回顾改革开放以来集体建设用地政策演变的3个阶段,即相对宽松的集体建设用地政策、严格管制下的集体建设用地政策、探索试点阶段的集体建设用地政策,并考察相应阶段的农民土地权益的表现,提出在稳妥推进集体建设用地政策创新的基础上,切实保护好农民合法权益的建议:(1)明晰产权,确保农民成为流转主体;(2)实行征地价格市场化;(3)建立城乡统一的土地市场;(4)细化耕地保护,完善配套措施。
It is reviewed three stages of the evolution of collective construction land policy in China since reform and opening-up,relatively flexible policy,strict policy to limit,and pilot policy.The farmers′ land property rights are analyzed at each stage in the evolution of collective construction land policy.Accordingly it is proposed while accelerating the innovation of collective construction land policy the measures to protect farmers′ legal land property rights are as follows.(1)Making clear the property rights to ensure farmers becoming the main part of circulation.(2)Implementing market-oriented land-expropriation prices.(3)Establishing a unified land market between urban and rural areas.(4)Detailing the land protection policy and improving supporting measures.
