摘要
立功制度是我国现行刑法中一项重要的刑罚裁量制度和刑罚执行制度。综观世界各国的刑法典,极少有类似我国刑法立功制度的规定。我国的立功制度存在着有悖公平、违背人性、瓦解社会道德等致命的缺陷,我国刑法应该取消立功制度。
Making contributions is an important sentencing institution and execution system prescribed in Chinese Criminal Law.Looking at the Criminal Codes of the countries all over the world,we find that very few in troduction of similar meritorious system.There exist many fatal flaws in our criminal meritorious ferformance system,which violates the principle of equity,runs counter to the laws of humanity and social morality.There fore,our meritorious performance system should be abolished.
