摘要
《合同法》无疑是目前我国民事领域中最为成功的立法,该法在诸多方面受到了联合国《国际货物销售合同公约》的影响。比较《合同法》与《公约》,在合同的订立、合同解除、违约责任与免责、买卖合同等方面,既可以看出前者对于后者的继受,也可以看出二者之间存在的若干差异。
It is no doubt that the Contract Law of the PRC 1999 is one of the most successful civil legislations of China.The law is affected by the CISG in many aspects.By a comparative study,it is showed that the Contract Law acknowledged a lot from the CISG in such as conclusion of a contract,termination,liabilities for breach and exemption,sales contract etc.Some differences between the Law and the CISG are also showed by the paper.
