摘要
行政诉讼涉及到行政权与司法权两种国家基本权力形态,是行政监督中较为重要的一种制度。其监督作用的发挥与行政诉讼体制有密切关联性,因此行政审判机构的组织结构、审理程序、人员配置对司法监督行政权的效能有重要的影响。对于我国行政诉讼体制的完善,应对域外行政审判组织相关状况进行考察,通过比较与分析目前我国行政诉讼体制的不足,才能明晰我国行政诉讼体制完善的思路。
The administration lawsuit involves two kinds of country basic authority shapes,which are administrative power and judicial power,is a important system in the administrative oversight.Its watch-dog function display is closely related with the administrative proceedings system,therefore,the administrative trial organization structure,the trying procedure,the personnel dispose have the important influence on the efficiency of judicial surveillance executive power.Regarding the consummation of China's administrative lawsuit system,we should carry on the inspection about the related condition of outside territory organization,find the insufficiencies of China's current administrative lawsuit system through comparison and analysis,to smake clearp that the road of perfecting the administrative lawsuit system lies in the jurisdiction independence.
