摘要
水土保持法是人们在预防和治理水土流失活动中所应遵循的法律规范,于2010年12月经重新修订颁布。在对比新旧二部水土保持法的基础上,分析新水土保持法在主旨思想、具体规定等方面的特点。结果表明,新水土保持法体现了新形势下我国对水土流失治理和水土保持工作的新要求,凸显了水土保持规划的作用,加强了政府部门的职责,细化了生产建设项目的监管内容,并强化了违反本法应承担的法律责任,因此,新水土保持法更能适应新形势对水土保持工作的要求。
As the legal norms to be followed in prevention and control of soil erosion activities,the Soil and Water Conservation Law was revised and promulgated in 2010.Based on the comparison of the new and old laws in the domain of the thinking in subject and the specific provisions etc,this paper regards that the new law reflects the new situation of soil erosion control and soil conservation work on current requirements,highlights the role of soil and water conservation planning,strengthens the responsibilities of government departments,makes the monitoring of construction projects more concrete,and strengthens the responsibility when violating the law.So the new law can better adapt to the new situation of soil and water conservation requirements.
