摘要
信托受托人的谨慎投资义务标准是现代信托法中的一个重要命题和难点问题。基于交易成本理论、法的公平与效率理念以及诚实信用原则,信托受托人应承担谨慎投资义务。两大法系关于信托受托人的谨慎投资义务标准无本质区别,中国应区分一般受托人与专业受托人,分别规定其谨慎投资义务的标准,并依受托人投资时的情况来判断其是否履行了该义务。
Prudent investment obligation of trustee is an important proposition and difficult problem in the modern trust law.The criterion of prudent investment obligation of trustee has not essential difference in the common law system and the civil law system.Our country should distinguish the criterion of prudent investment obligation between the general trustee and the professional trustee,and judge whether trustee has fulfilled obligation accounting to investment situation.
