摘要
黔东南州是我国一个少数民族聚集区,有着丰富的民族法学文化,因此,人民调解制度也具有鲜明的地域特征,但正是由于习惯法文化的强大力量,人民调解制度在实施过程中也出现了各种各样的问题,如何完善人民调解制度让其在纠纷解决中更好发挥作用,这也成为人民调解制度的优越性能否发挥出来的关键问题所在。
As a basic solution to disputes,People Mediating System has a long history in China.Qiandongnan,where exists rich ethnic law culture,is one of the prefectures where the ethnic minorities live.People Mediating System in Qiandongnan has its local characteristics,however,problems often occur in implementing the system because of the influence of ethnic customary law culture.This paper proposes some suggestions on how to improve People Mediating System so as to embody its advantages.
