摘要
器官移植技术的发展引发了诸多刑法问题,引起了法学界有关此类问题的争议。为了保障器官移植技术的健康发展,不少国家的刑法都对器官移植所引生的一些犯罪问题进行了明文规制。我国应当在刑法中增加对器官移植犯罪及其刑事责任的规定,并相应地完善我国器官移植的法律体系与立法内容。
The development of organ transplantation brings about many criminal problems, which stirs up discussions among jurisprudential circle. Quite a few countries have confined some of the problems of organ transplantation in order to ensure its healthy development. The organ transplantation crimes as well as their criminalibility should be prescribed in China＇ s criminal law. Moreover the system of China＇ s organ transplantation law as well as its rules should be improved.
