摘要
长期以来,我国《档案法》一直奉行建立公共档案利用与公布的二元制度。随着社会主义市场经济体制的确立,政府职能向公共服务、社会管理等方面转变,档案公布权的设定越来越不适应档案开放利用工作发展的需要。故在新一轮的《档案法》修订中,一方面,有必要考虑废止开放范围内的档案公布权,取消开放范围内档案公布主体的限制,鼓励社会各界参与档案公布的工作,形成档案公布与利用的有利局面;另一方面,为防止个别利用者在利用未开放档案过程中,随意扩大档案范围而产生负面影响,故有必要保留对未开放档案的公布权。
For a long time, archives law has been pursuing binary system in publication and utilization . With the socialist market economic system established,government functions turn to public services and social management, right of archives publication is not fit with utilization of archives. Hence, on the one hand ,new -round of the revised archives law should consider the abolition of the right of archives publication,canceling constraints to publication subject ,encouraging the social＇s participation and forming favorable situation in archives publication and utilization.On the other hand , it is necessary to retain rights of archives publication for the unopened in case that casually enlargeable utilization may cause some negative effects.
