摘要
在中国特色社会主义法律体系已初具规模的情况下,中国法治国家建设的战略重点应转移到法律实施的广阔领域,法律实施应该成为下一阶段中国法制建设的重点;在法律实施中,法律观念、法律意识起着重要的基础性作用。而在法律观念、法律意识中,规则意识则是最重要的归结点。当前中国法律实施的最大障碍是规则意识的缺乏,也是目前法律实施不甚理想的主要症结。应通过教育和制度约束的双重手段,大力加强和确立全社会的规则意识;在法律实施中,培养公民的现代法律观念是关键,也是实现法治国家的观念、心理和文化基础。现代法律观念应该是一个包括古今中外法律历史和实践中总结出来的系统性、开放性"图谱",这个"图谱"目前至少包括30余种的观念种类。
As the socialism legal system with Chinese characteristics has been formed to a certain extent, the strategic emphasis should be diverted to the broad area of law implementation. In the next step of the construction of Chi nese legal system, the implementation of law should be the main focus. The idea of law and the consciousness of law have basic functions in the implementation of law, and the latter plays most important role The absence of con- sciousness of rule is the most influential obstacle in the implementation of law in China and the main reason why the implementation of law is far from what they had been expected. The consciousness of rule of the whole society can be established through both education and rule binding. Cultivating modem idea of law is the main focus in law imple- mentation and it is also the conceptual, mental and cultural foundation for establishing a rule of law country. The modern idea of law should be a systematic and open map in which the idea of law of all kinds： historical and practical, Chinese and other countries＇, should be included. More than 30 categories of ideas are included at present.
