摘要
近年来农村地区开设赌场的违法行为猖獗,吸引了大量的赌徒赌博,赌博的规模及涉案金额远远高于一般的聚众赌博,严重扰乱了社会治安,社会危害性很大。我国对赌博罪的研究比较多,但对分立后的开设赌场罪研究还比较少。《刑法修正案(六)》对开设赌场罪的设置相比赌博罪已有较大的进步,但仍存在许多问题与不足,对农村地区开设赌场犯罪的状况、特点、原因进行分析,目的是为实务中打击该类犯罪提供帮助,以维护社会稳定。
The illegal casinos opened recent years in countryside often attract a large number of gamblers who make the scale and the money of gambling much higher than the general assembling gambling activities.It seriously disrupts social order and has great harm.There are many researches on the crime of gambling in China,but researches on the separation of opening casinos are still relatively few.＂Criminal Law Amendment（Ⅵ）＂has made great progress on the crime of opening a casino compared to the crime of gambling,but there are still many problems and shortcomings.The analysis of the status,features,cause of the crime of opening casinos can help combat the crime better.
