摘要
文章以结构主义为方法论,从三个方面分析和阐释了传统情理法文化的深层结构,即首先从司法和立法的维度分析了情理话语的形成,其次探讨了合情合理所蕴含的衡平观念,最后探讨了情理法文化下的权力技术问题。通过上述分析,阐释了传统语境下的"话语—知识"与"话语—权力"之间的相互关系。
This article bases on the methodology of the Structuralism and analyzes and explains the deep structure of the traditional legal culture from three aspects. Namely,we analyze the formation of "QingLi" from the judicial and legislative dimension firstly. Then we discuss the equity ideal of "QingLi". Finally,we discusses the problems of technique of the power in the traditional culture of "Sentiment/Reason/Law". Through the above analysis,we interpretation the co-relations between the "Discourse-Knowledge" and "Discourse-Power" in the traditional context.
