摘要
当前,由于我国民事执行检察监督的缺位,导致了实践中执行乱执行难的现象,严重侵犯了当事人的合法权益,影响了公正执法。因此,建议修改现行的民事诉讼法,加强民事检察执行监督,采取抗诉、检察建议等多种途径对民事执行活动予以监督,实现公正司法。
At present, the lack of procuratorial supervision in civil enforcement in China leads to the phenomenon of arbitrary enforcement and difficulty in enforcement, resulting in violating parties’ legal rights and interests and affecting impartial enforcement of the law. Therefore, it is necessary to modify the existing Law of Civil Procedure, to strengthen civil procuratorial supervision and enforcement, to take various means such as protest procuratorial suggestion, etc. to monitor civil enforcement activities to realized impartial jurisdiction.
