摘要
有效专利可从法律意义、经济意义、竞争意义等不同角度进行认定。近年来,我国有效专利规模虽然增长迅速,但国内企业的有效专利申请增长速度远不及外国在华企业的快,且国内企业的有效专利中发明专利明显不占优势。扭转这一状况,需统筹实施有效专利内生计划、外部激励、环境保障等对策,方能达到预期效果。
A patent in force could be verified from different perspectives like law,economy and competition.For the past few years,although valid patent of China has had a rapid development,foreign patent application goes faster and takes obvious advantages on invention patents.To reverse such a situation for achieving the expected effect,China should carry out the endogenous plan of valid patent with the supports of outside encouragement and environmental guarantee.
