摘要
针对劳动生活中的艾滋病问题,澳门相关的法律法规基本实现了雇员保护的立法理念,兼顾了雇主和利害第三人利益,但升级后的《劳动关系法》在很多具体的制度上还无法实现对劳动生活的全面保护。尤其是,集体合同制度尚处在起步阶段,集体劳动合同签订主体的法律地位、合同的作用方式和效力、集体合同与个别劳动合同之间的关系等问题还不明确。这些问题既不利于法律体系的构建,也不利于法律实务的解决,自然也就不能有效地维护雇员之合法利益,澳门劳动法的发展任重而道远。
As far as the AIDS issue is concerned, the related laws and regulations in Macao basically realize the legislation theory of protecting the employees, and also consider the employers and the third party's benefits. But, the updated Labour Relations Law still, in many aspects, cannot realize the overall labour protection. In particular, the collective contract system is still in its cradle, and the legal position of the main body for the collective contract, the style and efficiency of the contract, as well as the relationship between the collective and individual contracts are still indeterminate. These issues are beneficial neither for the construction of the legal construction, nor for the solution of the lawful practice, hardly able to effectively maintain the lawful benefits of the employees.
