摘要
契约式大学生管理模式体现了依法治校和以学生为本的管理理念。这一模式在理论上需要进一步明确高校与大学生的教育契约法律关系,进而区分契约关系中的行政契约和民事契约属性,区别运用不同的契约形式,重视大学生管理中的非契约因素;在实践层面要营造运行环境,科学制定契约,完善相应机制,防范契约失灵。
The contractual management model embodies the university management by law and student-oriented management concept. This model,in theory,needs a further clear identification of the legal relations of education contract between college and students,thus making distinction between the properties of administrative contracts and civil lease and the difference between different contractual forms,attaching importance to the non-contractual factors in the management of university students in,creating an operating environment in a practical level,formulating scientific contract and improving the corresponding mechanisms to prevent failure of the contract.
