摘要
和谐精神勾勒了中国传统文化的基本脉络和价值观念,并形塑为中华民族独特的精神追求与生活情趣。然而,就文明存在的实际形态而言,其在现实中并没有走得太远而更多的是停留在观念层面上。从宪政层面予以反思和省察,就会发现传统的和谐观念在多元主义、人文精神、制度构建等方面所存在的宪政之殇。如何消解传统文化中的消极影响,并对宪政文明与和谐社会这两个命题之间的内在关联、本质规定和价值取向作解构性的思考与探索,对于当代中国和谐社会的构建和宪政建设的发展具有基础性的意义。
Harmonious spirit is the fundamental context and values of Chinese traditional culture,forming the whole nationality＇s spiritual pursuit and joy of life.However,in the reality,it only remains in the aspect of concept,far away from the status as originally envisaged.There are obviously deficiencies of polyphyletism,humanism,system construction,etc,existing in the harmonious perception when it is examined from the view of constitutionalism.It has fundamental significance in the construction of harmonious and constitutional society to eliminate the negative impact of traditional culture and to take a distinct think and probe into the nature of internal relation and value orientation between constitutional civilization and harmonious society.
