摘要
探讨中药产学研联盟在促进中药专利保护方面的优势及方法。通过分析当前中药专利申报的情况以及中药产学研合作的优势,从开拓中药创新、提高专利申报的质与量、促进专利成果转化、引导中药领域标准及专利池的形成等方面探讨中药产学研联盟在中药专利保护方面的积极作用。中药产学研联盟汇集了中医药院校、科研单位、企业的人才、学术、资金、环境等多方面的优势力量开展中药创新研发,将研发的科技含量较高的成果申请专利,进而将专利产业化以获取经济与社会收益,在专利质量与数量达到一定的程度的基础上促成中药领域标准的形成与专利池的构建。
Object：To investigate the advantages and methods of the Chinese medical alliance in protecting Chinese medical patent.Methods：On the base of the analyses on the current Chinese medical patent’s quality and quantity as well as the superiority of Chinese medical alliance,this article will investigate the active role of Chinese medical alliance in Chinese medical innovating,improving patent’s quality and quantity,accelerating the patent’s transition,guiding the formation of medical Standards and patents pool.Results and conclusion：Above all,Chinese medical alliances possess the personnel,academic,financial and environmental property to carry on traditional Chinese medical innovation.Secondly,Chinese medical alliances may transform the high-tech results into patents,then make production to gain economical and social benefits.Finally,traditional Chinese medical standard and patent pools will come into being on the base of improving on patents’quality and quantity.
