摘要
业主成员责任是社员罚制度在住宅小区自治团体中的具体表现形式,旨在促进城市住宅小区共同生活秩序的稳定,保障居住环境的安定与和谐。作为住宅小区共同体自治权力的衍生物,业主成员责任的承担在一定意义上正是对业主权益的一种减损,这种减损必然进行正当性的考量。
Membership liability on the owners is the specific form of association punishment in owner self-ruling organization of urban residential. The aim of this research is to promote the common stable life of urban residential, and to protect the harmony of the living environment. As a derivative of the right of autonomy in residential community, membership~ liability is in a certain sense to de- tract from the interests of owners. This derogation is necessary to consider from the legitimacy.
