摘要
从目前北极国际事务的发展趋势来看,北冰洋沿岸国家以及其他北极考察大国越来越重视运用法律途径来确认、保障和拓展自身的北极权益,焦点领域主要集中在北极国际法地位、领土海域及大陆架划分、航道的归属与管辖、资源勘探与开发、环境保护等方面。我国近年来日益重视北极考察工作,但是从总体来看,相关研究及立法供给还无法满足保障我国北极权益的需要。探索我国北极考察及相关权益的法律途径,已经成为一项刻不容缓的重要工作。首先应当明确我国在北极法律秩序走向上的基本立场,之后从参与国际立法议程和拟定国内相关立法两个层面来开展有关的工作。
From the present tendency of international affairs in the Arctic,circumpolar nations and other Arctic expedition powers attach great importance to utilization of legal approach to identify,safeguard and expand their rights and interests in the Arctic.And the focus is on the Arctic status under the international law,land territory of sea area and the division of the continental shelf,ownership and administering of channels,resources exploration and development and environmental protection and so on.China has recently paid more attention to the Arctic expedition,but for some reasons,relevant research and legislation cannot protect the legal rights of our Arctic expedition.Therefore,to explore legal approach to safeguard the Arctic expedition and relevant rights and interests has become an urgent task for us.We should clarify our stand on the legal order of the Arctic,and then start our work by participating in international legislation and draw up domestic legislation.
