摘要
在我国刑法理论中,犯罪客体是一个研究相对薄弱同时又广受争议的范畴。文章从犯罪客体与犯罪构成、犯罪对象、法条竞合的关系入手,重新审视犯罪客体的重要作用,深入研究犯罪客体的相关范畴,从而让犯罪客体的潜在价值真正发挥出来。
In Chinese criminal law theory,the object of crime is a term with rare research and many controversies.In order to reveal the ture value of the object of crime,through the study on the relationship among the object of crime and constitution of crime,target of crime,overlapping of legal provisions,the essay reexamine the importance of the object of crime and research into the relevant definitions.
