摘要
《残疾人保障法》中规定了大量任务分配规范,这些规范除了价值宣示作用外,还通过"以虚御实"的方式调控着整个权力责任系统、引导着下位法规范的具体制定,其价值导向也对司法过程的法律适用产生一定的间接效力。不仅如此,这类规范还为改革尝试及开拓性举措提供合法性支持和约束。它们也隐含了提倡服务行政、增强公共服务的回应性的要求。需要理解它们的复杂功能,并且积极用好这类规范。
There are a great many task assignment norms in Law on the Protection of Disabled Persons,which not only declare the value but also practically control the entire system of power and responsibility and lead the specific legislation of lower level laws,and their value orientation has some indirect effect of law application in judicial processes.Moreover,these norms provide legal support and restriction for reform attempt and pioneer moves,as well as response to the need of service administration promotion and public service enhancement.Therefore,these complicated functions should be fully understood and the task assignment norms should be actively used.
