摘要
网络技术的发展、数字技术的应用,使图书馆获取作品更方便、快捷,也使图书馆陷入著作权侵权的困境。面对新技术的挑战,新的著作权管理、交易模式--数字权利管理系统(DRMS)应运而生,著作权人可以直接从使用者手中获得经济补偿。鉴于图书馆的公益特性和"有限提供"的作品传播方式,其在新交易模式下理应享有豁免权或优惠待遇。
The application of networks,digital technologies make the library access to works more conveniently and quickly,but also get the library into trouble of copyright infringement.Facing the challenge of new technologies,the new copyright management and transaction model-the digital right management system（DRMS） appears.The copyright owner can get directly economic compensation from the users.The commonweal character and the means of works transmission of limited offering allow the library to enjoy immunity or preferential treatment under the new transaction model.
