摘要
国际关系理论与国际法学的跨学科研究是晚近西方国家尤其是美国学界越来越重视的一种交叉学科的方法,现在,该交叉学科的方法也开始受到中国国际法学界的关注。从发展历史来看,国际关系理论与国际法学的学科交叉经历了"先合、趋离、后分、再合"的曲折历程,从20世纪90年代进入"再合"阶段以来,该交叉学科方法将哲学和政治学、经济学、社会学等各种社会学科的方法广泛地引入国际法研究,使国际法学走出了传统分析实证主义的"蜗居",极大地丰富了国际法理论,从而开启了构建"国际法理学"学科的新时期。
Recently,the inter-disciplinary study of International Relations (IR) and International Law (IL) has attracted more and more attention in the Western countries,especially in the U.S.,as well as among Chinese scholars of international law. In history,the relationship of IR and IL has gone through the four phases of 'together,getting-apart,apart and re-together.' As entering the phase of 're-together' since 1990s,it has introduced the methods of social sciences (including politics,philosophy,economy,and sociology) into the field of international law,which made the study of international law go beyond the traditional positivism,enriched the theories of international law,and opened a new stage for the development of 'the jurisprudence of international law'.
