摘要
在应对国际金融危机中,行政权表现出对经济社会生活深刻干预、自由裁量权激剧扩张、高速运行、运行方式多样化等积极扩张的特征。在肯定其积极作用的同时,必须对行政权保持警惕,以减少其扩张带来的危险性。而对扩张的行政权进行程序规制是实现选择,既能发挥行政权"善"的作用,又能抑制其"恶"的作用,因为行政公开可以减少腐败的可能性,公众参与可以提高行政决策的科学性,时限要求可以提高行政效率,比例原则可以制约行政权的滥用。
In dealing with the international financial crisis,executive right involves itself in social and economic activities in which the right of discretion expands fast and in various ways.Executive right can play a positive role but its expansion brings about risks.The formulation of its procedure rules can not only bring the potential of executive right into full play but also prevent its negative effects.The open administration can help prevent corruption,the participation of the public can help work out scientific policies,the time limit can help improve efficiency,and the control of power can help its abuse.
