摘要
夫妻法定共同财产制是调整夫妻财产关系的重要内容。但是,现行的法定夫妻财产制存在着财产内容不够明确、权利行使保障不足等问题。作为民法的组成部分,夫妻财产制应贯彻平等的基本精神。因此,有必要建立知识产权收益的期待权制度,明确继承或接受赠与及分居时财产归夫妻一方所有,确保夫妻双方对共同财产有平等的权利。
The system of couple’s statutory common property is an important part in adjusting couple’s property relationship.However,there exist some problems with the system such as indefiniteness of content and inadequacy of right insurance.As a component of civil law,the system should give play to the basic spirit of fairness.Therefore,it is necessary to establish an expectant right system of knowledge property profit to make clear the property right when one party inherits,or receives property as gifts or when the couple live separately,so that the right of the couple to share their common property can be ensured.
