摘要
驰名商标作为企业重要的知识产权和无形资产,是企业核心竞争力的重要体现、可持续发展的重要保证。驰名商标异化背离驰名商标存在的本意,不利于市场的健康发展。文章从驰名商标异化的概念出发,对驰名商标异化的表现及成因、危害进行了分析,并在此基础上提出了驰名商标异化的规制措施,以期对促进驰名商标保护制度的实践回归常态,符合法律的本意有所裨益。
The well-known trademark is one of the important intellectual property and invisible capital of the enterprise.It also embodies the company＇s core-competitiveness and guarantees the sustainable development.Alienation of well-known trademark is not good for market developing healthily and does not match the real value of well-known trademarks.Based on the conception of alienation of well-known trademark,the article analyzes the causes,harm and manifestation,and puts forward the regulate measures to promote well-known trademarks protect system.
