摘要
随着宁波—舟山港海运化工产品特别是有毒有害物质的日益增多,运输有毒有害物质污染的风险日益增强,但与之相应的法律和制度方面研究严重滞后,这使污染防控难以落实和保障。通过分析宁波—舟山港海运HNS风险的相关问题,探讨了世界海事组织的HNS议定书和美国的HNS污染防控机制,结合宁波—舟山港实际,提出海运HNS污染风险控制法律机制的对策,以实现对宁波—舟山港海运有毒有害物质污染风险的有效防控。
The risk of hazardous and noxious substance （HNS） pollution is rising dramatically with the increase of seaborne trade of chemical cargos in Ningbo--Zhoushan Port. The lack of research on legal framework and institutional arrangement further exacerbates the situation. In viewing the issues of Ningbo--Zhoushan Port HNS pollution risk, OPRC-HNS Protocol and U.S. HNS pollution response regime are discussed. Legal mechanism countermeas- ures are suggested in the light of Ningbo--Zhoushan Port reality so as to realize an effective control of Ningbo-- Zhoushan Port HNS pollution risk.
