摘要
有权利必有救济,没有救济的权利是没有保障的权利。由于传统理论对行政机关内部行为的认识存在偏颇,使得公务员的权利受到侵犯时无法寻求有效的救济途径。本文以内部行政行为之一"行政追偿决定行为"的性质界定为起端,探析了在"特别权力关系"理论急剧衰弱、民主法治、人权保障逐步高涨的背景下,当公务员的合法权益受到行政行为侵害时,应当拥有完全的救济权,以有效的保障自身的合法权利。
No relief, no right. The right is guaranteed by the relief. As the traditional recognition of internal behavior in the administrative systems often deviates from the fight way, the civil servants cannot find the effective relief to protect their rights when encroached upon. After defining the nature of the administrative recoupment act (one of the internal administrative acts), this paper inquires into the issue that when their legal interest is infringed by administrative acts,civil servants should possess the entire relief right confronted with the decline of the theory of special power relationship, the rise of democracy, rule by law and human right protection, in order to the achieve effective protection.
