摘要
从补偿与产权的一般关系,分析我国耕地保护经济补偿涉及到的耕地产权问题,在此基础上,阐述我国耕地保护经济补偿的主体和对象。补偿主体包括中央政府、未承担耕地保护责任的地方政府、非农企业、社会组织以及公民;补偿对象包括拥有耕地承包经营权的农户、耕地未承包到户的农村集体经济组织、过多承担耕地保护责任的地方政府。
In accordance with the general relationship of compensation and property right,the problem of cultivated land property right involved in the economic compensation of cultivated land protection in China was analyzed.On this basis,the subject and object of economic compensation for cultivated land protection in China were elucidated.The compensation subject includes the central government,the local governments with responsibility not assumed,non-agricultural enterprises,social organizations and citizens.The compensation object includes the farmers with right to cultivated land contractual management,the rural collective economic organizations with household having not right of cultivate land and the local governments with excessive responsibility for cultivated land protection.
