摘要
因特网构建起的电脑信息空间，对传统知识产权制度提出了严峻挑战。对此，本文探讨了三种集中表现：新型信息作品对“内容、形式”二元论版权保护准则的冲击；法律保护在智力成果创作人利益与人力物力投入的投资者或竞争者利益之间如何平衡；网络域名管理规则如何解决种种纠纷。最后，本文认为，知识产权保护制度应采取“渐进”，而非“革命”的措施。
The computer in formation space constructed by the Internet sets sever challenge to the traditional intellectual property system. This paper intentionally diseases three major display ie, how the new information works give lashes to the copyright protection principles of the content-form dualism; how laws keep beneficial balance between the intellectual achievements makers and the program sponsors or the contests; how the domain-name management system solve disputes. In the end, the paper claims that the intellectual property protection system should adopt an ' evolution' while not a ' revolution' to serve the technology revolution as an 'echo' made by the system refoorm
