摘要
侵权请求权优先权是《侵权责任法》规定的一个新制度,是法定的担保物权,其成立应当具备法律规定的必备条件。侵权请求权优先权的效力包括担保范围、标的和对抗对象。侵权请求权优先权保障能够在私人权利与国家利益发生冲突时,最大限度地保护私人权利。研究此问题意义极为重大。
